Crime Reporting and its Significance in Criminology

Crime Reporting and its Criminological Significance Abstract The subject of this thesis is the interdisciplinary issue of crime reporting and related latent criminality, especially from the criminological, victimological and criminal-positive perspective. The diploma thesis is divided into four parts that as a whole are intended to answer the question whether the Czech legislation is sufficiently effective in contributing to the achievement of low figures of latent criminality. The first part is devoted to the definition of the key concepts of this thesis and the question of what are the most common factors determining the decision of certain persons to report a crime to law enforcement authorities. The answers to this question are then provided mainly by the examination of the fields of criminology and victimology. In the second part I examine in detail the criminal law regulation of the institution of crime reporting. This part contains chapters on the procedure prior to the initiation of a criminal prosecution, the filing of a criminal complaint itself and its significance, and the actions of law enforcement authorities related to the filing of a criminal complaint. Legal status of whistleblowers in relation to the refugee status Abstract The aim of this thesis is to introduce the whistleblowing issue in context of international law, refugee law specifically. In recent years, there have been several globally significant cases of whistleblowers responsible for leaks of information of i.a. public entities and seeking protection against their own state of nationality in other countries. Despite the worldwide attention that these cases got, the problematics of whistleblowing is not sufficiently covered from the perspective of international law. Especially in Czech law literature, this topic is neglected in such context. The object of the thesis is therefore to provide an overview of the issue and to identify and analyze its controversial aspects. The work is structured from general introduction into the topic, thereafter defining crucial terms and institutes and categorizing them, towards detailed analysis of the status of whistleblowers and each of refugee definition parts in particular. The core of the work itself is constituted of application of these definition characteristics to miscellaneous whistleblower cases, with the purpose of answering the research question whether (and under what condition) could whistleblowers fulfill the refugee definition. in English The author's thesis deals with the topic of whistleblowing, which is currently very relevant, because two legislative proposals about the protection of whistleblowers have been submitted recently and also because of the adoption of Government Regulation No. 145/2015, which establishes treatment of notification for state employees. The thesis discusses and presents the views of many authors on the concept of whistleblowing, whistleblower, further it clarifies the division of internal and external whistleblowing and also divides the reporting of whistleblowing on public, confidential and anonymous. The work also presents the history of qui tam actions that are highly associated with the history of whistleblowing. The thesis presents selected aspects of foreign whistleblowing arrangements, namely in the United States of America, which has a long tradition of whistleblowing. The new law to protect whistleblowers, which is effective from 1st January 2015 in the Slovak Republic, is examined in the thesis as well. The arrangament of whistleblowing in the Czech republic and in Slovakia

The bachelor thesis is deal with arrangement of whistleblowing in the Czech Republic and in Slovakia. The thesis is divided into three chapters. Due to ignorance of this problem in both countries the first chapter follows the whistleblowing theoretically and explains this concept including the concept of whistleblower. The second and the third chapters specifically analyze the situation of whistleblowing in the Czech Republic and in Slovakia. The goal of the bachelor thesis is find out whether whistleblowing is regulated by comprehensive law in these countries, how will look with it in the future and what the public's sight of it is.
